On the eve of passing the investigative deadline, Kosovo Special Prosecutor Habibe Salihu had invited Rajaj to reach agreement on admitting guilt.
By this agreement, special prosecutor Salihu recommended to the court the 18-month prison sentence of Rexaj as much as she had remained in custody and house arrest, as well as a fine of 10,000 euros.
This recommendation found support in Article 230 paragraph 1 and paragraph 1.1 of the Code of Criminal Procedure, which envisions lowering the sentence for the accused to reach agreement on admitting guilt for the criminal act accused by the State Prosecutor.
However, beyond what the Criminal Procedure Code envisions, the special prosecutor had entered into agreement conditioning the return of property to the victims, which had been taken advantage of by carrying out the criminal act.
The deal was that the victim of M.I in the 1st year term from the indomitability of the act returned 130 thousand euros to the file, while the latter in the 15-day term from accepting money into the account returned property to the victims, even as he had benefited from the same through carrying out of the criminal act, Fajdija).
Tutje, within a year’s term, Rexhaj was obliged to enable victims to sell any of the properties in order to obtain the same amount of 130 thousand euros.
