Who said prosecutors couldn’t investigate without permission? Faithful R. Berisha reveals the Special Prosecutor’s announcement: An administrative procedure erupted as a reform

Have the hands been freed to Special Prosecutor’s Prosecutors, or is a simple administrative change being presented as major reform in the fight against crime? Faithful Lawyer R. Berisha has reacted to the interpretations following the latest communiqué of this institution, clarifying that taking the number of subjects through the chief prosecutor has never been equal to seeking permission to launch investigations.

Berisha has questioned the way the change was presented, stressing that prosecutors have not now gained a competence they previously lacked.

The subject’s number is not permission to investigate!

According to Berisha, the administrative practice that has been implemented since 2018 was for prosecutors to seek the number of subjects through the chief prosecutor, but that did not imply that they should take his consent to launch investigations.

They asked for numbers to register the course, not permission to investigate, Berisha has clarified.

He has also stressed that there is no knowledge of any cases, during this period, when a prosecutor has been refusing to give up the number of subjects.

Commenting on the change warned by the Special Prosecutor, Berisha has explained that the number of courses from now on will be taken directly from the Register Office, which, according to him, constitutes cutting an administrative procedure and not changing the legal competencies of prosecutors.

Now, according to the announcement, the number will be taken directly from the Record Office. So, a certain administrative route is reduced. That’s it.

Berisha has estimated that any procedural relief is welcome, but has warned that such a change should not be presented as release of prosecutors from a legal obstacle that, according to him, did not exist.

The prosecutor’s autonomy doesn’t start at the classroom. It stems from law, Berisha stressed.

According to him, simplifying administrative procedures should not be confused with substantial reforms in fighting crime.

In the end, Berisha has stressed that the success of the prosecution institutions should be assessed by the quality of investigations, provided evidence and results in the court, not by the way of the records.

Crime is not fought by classes. Fighting bold, legal and professional investigations, Berisha has concluded.
