GThe Supreme coat has abolished the provision for keeping the driver’s license until the completion of the safeguard clause.

According to the announcement, it has been estimated that the provisional takeover of police license and protection of the vehicle’s ban are two different judicial institutions, which should not be confused with their implementation.

By referring to Article 244 of Law No. 08/ L-186 for Road Traffic Rules, the Court has found that temporary police driver’s license maintenance cannot last more than eight days. Consequently, conditioning the withdrawal of the document with the completion of the safeguard clause, which can last three, six, or twelve months, is contrary to the law.

The Supreme One says that a sublegal act cannot expand the powers determined by law, nor can it impose additional restrictions that have no legal basis.

The court has refused as baseless the request for the abolition of paragraphs 1 and 2 of Article 17 of this Administrative Guide, assessing that these provisions have procedural and organisational character, since it sets out the police unit responsible for the management of the document and the obligation to issue bail for the provisional obtaining of the driver’s license without exceeding legally defined authorization.
