Kosovo Prosecutorial Council ( The KKP has published the decision to suspend the chief prosecutor of the Constitutional Prosecutorship in Pec, Joy Vucetaj, detailing the reasons that led to this disciplinary measure.

According to the decision on October 29th, State Prosecutor Zejnul Gashi had requested the launch of disciplinary investigations into Vucetaj, following the review of a report drafted by the co-ordinator for domestic violence at the chief state prosecutor’s office.

The ruling is said to have argued that Vucetaj, in the quality of the founding prosecutor’s leadership in Pec, had been aware of the ongoing demands of Arlinda Zekaj, which was the party damaged in cases handled by this prosecutor.

According to the report, the chief prosecutor was informed of the urgency of Zekiaj’s demands and the fact that her life was facing danger. She, according to the document, had also been aware of the prosecutors’ reports that had handled her cases, as well as of official police reports concerning the level of risk.

The decision reportedly had also been announced by the Prosecutorial Council, its leader, Arjan Gashi, and the Office of State Chief Prosecutor, who had sought to address Zekiaj’s urgent demands.

However, according to the Competent Authority’s assessment, it had failed to take the necessary prosecutorial actions, not taking into account the seriousness of the requirements filed.

The document stresses that these acts allegedly constitute disciplinary violations, including disrespecting the rights of damaged parties, particularly the right to protection, security and privacy. The reasoning also mentions continued neglect to address urgent demands, which, according to the Competent Authority, had led to fatal consequences for Zekiaj.

For these reasons, on October 29th, the state chief prosecutor had requested the launch of the disciplinary procedure and the suspension of Vucetaj, with the goal of maintaining the integrity and effectiveness of the investigations.

The KKP has approved the application and has decided to suspend Vucetaj immediately from performing official tasks, with 50 per cent of the salary, until another Council decision.

The decision to suspend it was taken on 29 October, while the disciplinary procedure against the chief prosecutor is in the phase of the investigation.
