The court, unanimously, has declared the request acceptable and found that failure to keep the hearing violated Article 31 of the Constitution and Article 6 of the European Convention on Human Rights.

As a result, the Constitution has deemed the act of February 5, 2026 of the Appeals College invalid, in terms of A-0003 complaint, and has returned the case for review.

The case is related to a contest initiated by the late preteller’s husband, who had demanded involvement in the final list of workers who had the right to benefit 20 percent from the privatisation of the social company ʹLanding of drivers.

His request was rejected by the respective bodies, while the complaint had been reviewed on both steps of the Supreme Court’s Special Chamber without hearing being held.

In its reasoning, the Constitutional Court stressed that the right to a fair process includes both the rule and the right to hearing. According to her, in this case there were no extraordinary circumstances that would justify the lack of hearing, as the issue was not exclusively legal or of a high technical nature.

The court explained that the consistent violation relates only to the procedural aspect, respectively, to the failure of the hearing, and that this ruling does not prejudge the final outcome of the conflict in fair courts.
