Lawyer Besnik Berisha has raised questions about whether Arlinda Zekaj’s murder could be prevented, saying the family has not yet received answers to the issue.
Berisha has stressed that institutions have the obligation to account for the way they acted after warnings of the danger facing Arlinda, since, according to him, the state cannot ignore cases when it reportedly threatens the lives of citizens.
There’s still an open question, can you prevent the murder of Arlinda Zekiaj? That question is their obligation to answer because that question is not answered. The family is expecting this response, Berisha has declared it in Débat Plus.
He has clarified that the state cannot guarantee the lives of any citizen under any circumstances, but he has the responsibility to react when warned of a possible danger.
Let’s underline one more fact, the state cannot guarantee every life, and there is no expectation of the positive right that each citizen should necessarily have a guarantee of life, but there is expectations and obligation of the state that whenever it is warned of a risk of life, it cannot be ignored. You can’t ignore him, he has to investigate, he said.
Berisha has estimated that until now evidence has been made public and statements that, according to him, testify to the failure of institutions in protecting Arlinda.
I believe, to this day we have sufficient evidence, and statements given by the speakers of those paid by our taxes to make policies, rules and laws, that the state has failed. He failed to protect his life. But so far what is known is that there has been failure in co-ordination, in the execution of management, Berisha has declared.
