Judith Akil Gjakova will appear this month before the Court of Appeals, under the criminal procedure for domestic violence against his former husband, Samantha Muminovic.

According to the Court of Appeals’ announcement, which the Isander newspaper provided, the college session will be held on November 25, 2026, at 10:40 at the facility of the Palace of Justice in Hyvali.

The Appeals document shows that the session was scheduled for a review of the Pajje Department General’s complaint, as well as a complaint by the authorized representative of the injury, lawyer Aurora Mulhrama.

The incidents were filed against the Act of Constitutional Court in Pec, on which Gjakova had been acquitted of criminal acts in the family.

What happened?

The case was made public in April 2024, after the former Judist’s wife had denounced him for domestic violence. At the time, the couple were in the process of divorce and had a child.

After the indictment, the State Prosecutor had authorised the Kosovo Police for the arrest of Gjakova.

He had been declared on the run because he had not been found immediately by the authorities, while a few days later he had surrendered to the border checkpoint in Morina.

The Constitutional Court in Pec had not approved the prosecution’s request for the detention assignment.

Instead, there was a safeguard against him and a ban on his wife and her residence. In the decision issued by Insander at the time, Gjakova was forbidden to approach the injured and where she lived at a distance of 50 meters.

The decision provided additional measures regarding contact and its protection. The defense order, provided by Inseder, claimed that physical and psychological violence had begun since July 2023. The document also mentioned the claim that the child had witnessed an episode of violence.

Also, according to the request, on April 13, 2024, their ex-wife and child were not allowed to enter the joint residence. It had been forced to seek refuge, and, according to timely reporting, it was sheltered in relevant institutions.

What Is Said in the Spouse

The founding prosecutor in Pec had filed the indictment against Gjakova in December 2024. In his indictment, he was charged that during the period from 2023 to April 2024, he had committed psychological and physical violence against his mate. According to the condition of the indictment, published earlier by Insander, it was about verbal threats, insults and coup claims in various parts of the body.

The prosecution’s file also mentioned threatening and denigrating messages allegedly sent to the injured. The prosecution claimed that actions had caused constant fear and psychological pressure. These are claims by the Prosecutor and the damaged party, which have not been proven by decision of the cut form.

Achilles Gjakova enjoys presumption of innocence until a final court ruling.

The Foundation Court cleared him of the prosecution

After the trial, the Constitutional Court in Pec, in the General Department, had acquitted Gjakova of domestic violence. The decision was made by Judge Shaqa Curri.

The court had made it known that the damaged had been instructed that the property-juridical request be carried out in civil conflict procedure. The announcement of the liberation act said the parties were eligible for complaint within the 30-day legal deadline from the day of the plea. These very complaints will now be considered by the Court of Appeals.

The Apel document finds that at this stage of the procedure, not a new charge is being considered, but complaints to the first degree decision. The college will assess the party’s claims and the legality of the Constitutional Court’s act.

Judo Federation Reaction

By the time Gjakova was declared at large, the Kosovo Federation of Judo had declared that it condemned any form of violence, but at the same time expressed conviction in the sportsman’s innocence. The Federation had demanded that institutions handle the case and the media be cautious, rejecting, as expressed, public prejudice against one of Kosovo’s most popular athletes.

Akil Gjakova is one of the most popular names of Kosovo Judo and has represented the country in major international competitions. It was because of his public profile that the case had received great attention, although part of the public reports had focused more on his sports career than on the content of the court documents. Now, for the second time, the case will be in the hands of a second-degree court.

The November 25th session will show whether the free trial will remain in effect or whether the case will be returned for review
