Frokaj was originally sentenced to a unique sentence of 21 years in prison by the Constitutional Court in Pec on 30 April 2025. However, this act had been annulled by Appeals, and the case had turned into retrial.

In the decision to return the case to the retrial, Appeals had arranged substantial violations of criminal procedure provisions and shortcomings in the assessment of evidence. The second – degree court had also opposed the rescinding of criminal activity from serious suicide to suicide, committed by the Foundation.
According to the Constitutional Prosecutor’s Act in Pec, the event took place on August 7th 2023, when Frokaj allegedly fired seven times towards Prelaj.
The prosecution claims that the accused had initially fired four shots at the victim and had returned and fired three more shots as he left the bar. By such actions, he had apparently deprived Preline of life and had risked other people present.
Frokaj was also charged with possession of illegal weapons, austerity, and possession of violent wealth over actions allegedly committed during leaving the scene.
