The Constitutional Prosecutor in Pristina has filed charges against J.P. And a legal person, under suspicion of committing a criminal offence… and public procurement fraud.
According to the indictment, on January 19, 2024, J.P., in the quality of the director and person responsible for the company, P.P.K. allegedly presented false documentation during the bidding of a procurement activity announced by the Ministry of Health.
The procurement event involved évourising medical supplies from LE (Esenscial List) while the group of economic operators had submitted bids for Lot 1, worth 344 thousand and 955.77 euros, and Lot 3, worth 169 thousand and 12.36 euros.
According to the prosecution, ISO 13485:2016 certificate, issued by the certificate authority NQAH for producer ʹForlong Medical Co., Ltd therefrom China. The document was submitted as evidence of meeting the second criteria of the tender file, which relates to technical and professional capacities.
According to the indictment, however, the certificate had expired and was canceled in October 2022. The prosecution doubts that the submitted document also changed the date of validity from October 18, 2022 to October 18, 2024.

He allegedly deliberately violated the rules of public procurement in order to launch contracting authority regarding meeting the tender criteria and influence the evaluation of the contract offering in the interest of the company R.M.
In the case of the establishment of the indictment, the prosecutor of the case has proposed to the competent court that, after judicial examination and trial management, the defendants be found guilty and sentenced according to the law for the criminal offense.
