At the Constitutional Court in Pristina on Wednesday, in the trial against the two former ATK and others, the final word has been given by parties in the procedure. The prosecution stood by the written word, while defenders of the accused demanded a free trial.
In this case, the two former ATK inspectors — Ramadan Ibishi and Selatin Hoxha — are charged with criminal work {launch of official secrecy. With them, for help in discovering official secrecy, Ibishi is also accused of being noble, while organizing pyramid schemes or illegal gambling are accused of Skender Fetaj, Ramadan Latifi, Dritton Hadzija, Arian Kastrati, Burim Ismajli. Latif is also charged with illegal possession, reports Justice Trust.
Initially, the defender of the accused Skender Fetaj, lawyer Mahmut Halimi, called attention to the issue that the financial expertise taken during the investigation phase, as well as highlighted as proof of the indictment, has not been administered as evidence in the subject’s paperwork and considers it to be part of the evidence.
The trial panel headed by Judge Donika Shala-Abdyli decided to manage financial expertise as well.
Special prosecutor Arbesan Racan-Shala delivered the final written word and declared she remains in whole next to her.
In final words, lawyer Halimi claimed to stand by the written word, adding that his defender had fallen victim to various groups that have seriously damaged him, and another procedure is being implemented.
Halimi added that with financial expertise, there has been evidence that there are no tax evasion, money laundering or organised crime.
While the defender of accused Arian Kastrati, lawyer Shpend Gashi said he stands in all, close to the final word delivered in writing.
The defender of accused Driton Hadzija, lawyer Granit Bocshi, said that even if the claims as in the indictment were true, the question is whether the elements of the criminal work with which he is charged are fulfilled.
Lawyer Bocshi added that the prosecution claims 18 duplicate devices and 4 of them without licenses were found, but in fact, according to him, these devices were licensed.
He also highlighted the legal implications of changing the Law for Game of Fate, with which the games of fate have been banned, and on another similar occasion it has been found that the criminal act with which the accused are charged is decontinent,
While defendant Ramadan Latifi’s defender, lawyer Driton Musliu said he stands by the final written word and that no element of illegal gambling has been met, adding that his defender has paid all taxes, and called for a free trial.
While, concerning the weapons found at the house of Latifi, Musliu said they are inherited, also seeking release from bail.
The accused Latifi claimed to have business with license and work permits, while on the contrary tax evasion, as evidenced by expertise, has paid the state 16 thousand euros more.
He added that he is the victim of institutional organised crime by a group of policemen led by Behar Milaku, where, according to him, their goal was to get the business out of the market through huge fines where fines were pronounced in many 76 thousand euros by one afternoon.
For the end, Latifi asked the Court to judge and pronounce him innocent.
While accused Burim Ismajli’s defender, lawyer Fatmir Koumejaj, said he stands by the final written word.
The defender of the accused Selatin Hoxha, lawyer Hope Hossa, delivered the final written word and added that in no way has the work burdened her defenders been proved.
She stressed that the Court of Appeals has declared all observations as unacceptable evidence, and that it hopes in a legal act.
The defender of Ibishi’s noble accused, lawyer Ali Beka, said the entire base of the indictment for protecting his defense is on telephone wiretapping that have been declared illegal.
While the defender of the accused Ramadan Ibishi, lawyer Mejid Syla, said he stands by the final written address and is convinced that the Court will make the decision that Ibishi will be acquitted of, since with none of the administered evidence the Ibishi name is laundered.
After declaring unacceptable evidence of wiretapping, the coma rightly expects the prosecution to give up the indictment regarding Ramadan Ibishi, unfortunately this did not happen.
Later, Judge Shala-Abdyli announced this judicial investigation and appointed the announcement of the trial for another date.

According to the indictment filed on May 28, 2019, defendants Skender Fetaj, as business owner EGTK II sh.g.k., Arian Kastrati and Driton Hadzija as managers have organized or participated in the organization of fortune games.
