Under the decision of October 27th 2026, the Supreme Court has estimated that the KKP’s decision to remove Isufaj from the chief prosecutor’s position is not a disciplinary decision, but an individual act of administrative character.

For this reason, the Court has found that the complaint cannot be considered by the Supreme Court on the basis of Article 15 of the Law for the Disciplinary Responsibilities of Judges and Prosecutors.

In its reasoning, the Supreme Court has stressed that the legality of the KPK’s decision could be subject to judicial control through administrative conflict procedure, before the competent court.

The KKP, on October 2, 2026, had decided to remove Isufaj from the position of chief Special Prosecutor, citing mismanagement, non-competency, failure to perform tasks and failure to meet performance standards.

Following that decision, Isufaj had filed a complaint with the Supreme Court, rejecting the procedure followed by the KKP, law enforcement and performance assessment, as well as seeking cancellation or changing the decision on his departure.

The KKP, in its response, had opposed the Supreme Court’s competence to review the complaint, arguing that the decision to leave the leadership position was not a disciplinary decision.

The Supreme Court has estimated that the departure from the chief prosecutor’s position, based on Article 22, paragraph 5 of the Law for the Kosovo Prosecutorial Council, differs from the disciplinary responsibility of prosecutors.
